TERMS AND CONDITIONS OF THE CAMPERPARTS3D.PL ONLINE STORE

The owner of the online store operating under the domain www.camperparts3d.pl is FHU "FIT-SHOP" Daniel Cieślak.


§1. DEFINITIONS

1.1 Seller / Service Provider

A natural or legal person selling goods or services offered to the Buyer.

1.2 Customer

An adult natural person with full legal capacity, a legal entity, or an organizational unit without legal personality but possessing legal capacity, making purchases from the Seller directly related to their business or professional activity.

1.3 Consumer

An adult natural person with full legal capacity making purchases from the Seller not directly related to their business or professional activity.

1.4 Buyer

Both the Customer and the Consumer.

1.5 Civil Code

The Polish Civil Code Act of 23 April 1964, as amended.

1.6 Postal Address

First and last name or institution name, including city, street, building number, apartment/unit number, and postal code.

1.7 E-mail Address

An electronic mail address enabling the sending and receiving of messages via the Internet.

1.10 Online Store

An online service available at www.camperparts3d.pl through which the Buyer may create an individual account and place orders.

1.11 Order Form

A form completed by the Buyer for placing an order in the Online Store.

1.12 Offer

Goods and services offered and available to Customers in the Online Store.

1.13 Order

A declaration of intent made by the Buyer via the Online Store using the order form, clearly specifying the quantity and type of products, delivery method, payment method, and Buyer’s details, directly leading to the conclusion of a contract between the Buyer and the Seller.

1.14 Product

Any item available in the Online Store together with its gross price and quantity selected by the Buyer in the order form.

1.15 Delivery

A specified method of delivering or collecting purchased products from the Seller to the Buyer, including the carrier, delivery costs, and pickup point.

1.16 Pickup Point

A location where the purchased products are handed over to the Buyer.

1.17 Payment

A method of payment for the purchased products including delivery costs.

1.18 Agreement

A mutual agreement between the Seller and the Buyer defining their rights and obligations, concluded either in the Seller’s physical store or remotely via the Online Store in accordance with the Consumer Rights Act of 30 May 2014 for Consumers and Article 535 of the Polish Civil Code for Buyers.

1.19 Proof of Purchase

Confirmation of the agreement concluded between the Seller and the Buyer in the form of a receipt or VAT invoice in accordance with the applicable tax regulations.

1.20 Order Fulfillment Time

The number of business days from the moment the order is placed and confirmed until the purchased product is delivered to or collected by the Buyer.

1.21 Defect

Non-conformity of the sold item with the agreement, particularly if the item:

  • does not have properties typical for such goods,
  • does not have features assured by the Seller,
  • is not suitable for the purpose specified by the Consumer,
  • was delivered incomplete,
  • shows signs of damage,
  • lacks features assured by the manufacturer or distributor.

1.22 Complaint

A legal claim submitted by the Customer to the Seller regarding unsatisfactory product quality or improper performance of services, particularly requests for repair, replacement, re-performance of services, price reduction, or refund.

1.23 Consumer Law

The Consumer Rights Act of 30 May 2014.


§2. GENERAL PROVISIONS

2.1

The agreement is concluded in the Polish language in accordance with Polish law and these Terms and Conditions.

2.2

The pickup point for purchased products must be located within the territory of the Republic of Poland or the European Union.

2.3

The Seller undertakes to provide services and products free from defects and declares that all products offered are brand new.

2.4

All prices displayed in the Online Store are expressed in Polish Zloty (PLN) and include VAT. Delivery costs are added separately.

2.5

All deadlines are calculated in accordance with Article 111 of the Polish Civil Code.

2.6

The Seller undertakes to inform Buyers about any known manufacturer warranties covering products offered in the store.

2.7

The Seller does not charge additional fees for communication using remote communication methods. The Buyer bears only costs resulting from agreements with their telecommunications provider.

2.8

The Seller ensures proper functioning of the store in the latest versions of popular web browsers including Google Chrome, Mozilla Firefox, Microsoft Edge/Internet Explorer, and Safari.

For full functionality of the Online Store, SSL encryption, JavaScript support, and cookies must be enabled.

2.9

The Buyer may create an individual account and save login details for future orders. The Buyer is responsible for maintaining the confidentiality of login credentials.

2.10

The Buyer agrees:

a. to use the Online Store in a manner that does not interfere with its operation or the rights of other users,

b. to use content published on the website solely for personal purposes,

c. to use the Online Store in accordance with applicable laws and these Terms and Conditions.

2.11

The Customer may use out-of-court complaint and claim settlement procedures.

§3. OFFER AND SCOPE OF SERVICES

3.1

The Seller offers mail-order sales throughout Poland and selected international destinations via the Online Store.

3.2

The Seller enables Customers to create accounts necessary for placing orders.

3.3

The offer displayed in the Online Store is binding with regard to price during the period in which it is published.

Products marked as “OUT OF STOCK” are for informational purposes only and do not constitute an offer within the meaning of the Civil Code.


§4. DELIVERY, PAYMENT METHODS AND COSTS

4.1 Delivery Methods

The Seller offers the following delivery methods:

a. Courier delivery via InPost

b. Postal shipment via InPost

c. InPost Parcel Locker delivery

d. Courier delivery via DPD

e. International shipments via DPD and InPost

4.2 Payment Methods

The Seller accepts the following payment methods:

4.3

Products are shipped to the address provided by the Buyer in the order form.

4.4

The standard order fulfillment time is 4–7 business days.

4.5

If a product is unavailable, the Seller will inform the Buyer immediately via phone or e-mail.

4.6

For online payments, the Buyer should include the order number in the transfer title. Order processing begins after payment confirmation.

4.7

Product prices displayed in the Online Store include VAT and customs duties where applicable. Delivery costs are added separately.


§5. CONDITIONS FOR CONCLUDING SALES AGREEMENTS

5.1

By placing an order, the Customer confirms acceptance of these Terms and Conditions and agrees to comply with them.

5.2

Orders may be placed 24 hours a day. Order confirmation and processing take place on business days from Monday to Friday between 8:00 AM and 4:00 PM.

5.3

To place an order, the Buyer must:

a. log in to their individual account,

b. select products and add them to the shopping cart,

c. choose a delivery method,

d. choose a payment method,

e. complete the delivery form correctly,

f. confirm the correctness of the order details.

5.4

Orders paid by cash on delivery are processed immediately after the agreement is concluded.

Orders paid via bank transfer or electronic payment services are processed after payment has been credited.

5.5

The Seller undertakes to dispatch orders within the timeframe specified in these Terms and Conditions.

5.6

Purchased products are delivered together with the selected proof of purchase.

5.7

If the dimensions or weight of the order exceed carrier limits and additional costs arise, the Buyer will be informed immediately and may either accept the additional costs or cancel the order.

5.8

The Buyer authorizes the Seller to issue VAT invoices without the recipient’s signature.

5.9

Orders will not be processed if:

a. the order form has been filled in incorrectly,

b. the order cannot be confirmed within 2 business days,

c. the order raises justified concerns requiring verification.


§6. RIGHT OF WITHDRAWAL

6.1

In accordance with Article 27 of the Consumer Rights Act, the Consumer has the right to withdraw from a distance contract within 14 days without giving any reason.

6.2

The declaration of withdrawal must be submitted within 14 days from delivery of the goods.

6.3

Sending the declaration before the deadline is sufficient.

6.4

The Seller will immediately confirm receipt of the withdrawal declaration.

6.5

In the event of effective withdrawal, the agreement shall be considered void and all payments shall be refunded.

6.6

Returned goods should be sent back no later than 14 days after withdrawal.

6.7

Any advance payments are refunded together with statutory interest where applicable.

Refunds are processed within 7 days of receiving the returned goods.

6.9

The Buyer bears the direct costs of returning the goods.

6.10

Refunds are made using the same payment method used by the Buyer unless agreed otherwise.

6.11

The right of withdrawal does not apply to:

  • services already fully performed,
  • goods dependent on financial market fluctuations,
  • personalized/custom-made products,
  • perishable goods,
  • newspapers and magazines,
  • gambling-related services.

§7. WARRANTY AND LIABILITY FOR DEFECTS

7.1

The Seller may exclude liability towards business Customers to the extent permitted by Polish law.

7.2

The Seller is liable towards Consumers for defects in accordance with applicable Civil Code provisions.

7.3

In the event of a defect, the Buyer may request:

a. a price reduction,

b. withdrawal from the agreement,

unless the Seller immediately replaces the defective product with a defect-free one.

7.4

The Buyer should immediately report any transport damage or defects.

7.5

The store does not accept COD return shipments.

7.6

Acceptance of a shipment without reservations and failure to prepare a damage report with the courier may limit claims related to transport damage.

7.7

The Buyer bears the cost of returning complained products. In justified cases, the Seller covers the return shipping cost to the Buyer.

7.8

Complaints should include proof of purchase and a completed complaint form.

7.9

Complaints are reviewed within 7 business days.

Defective products will be replaced or refunded if replacement is impossible.

7.10

Food supplements sold in the store are not covered by a manufacturer warranty and are subject only to expiration dates in accordance with food regulations.


§8. PRODUCT EXCHANGE

8.1

The Seller allows product exchanges provided that the goods are unused and undamaged.

8.2

The Buyer should complete the exchange form and send it together with the product and proof of purchase.

8.3

The Buyer bears shipping costs related to exchanges.

8.4

This procedure does not apply to justified complaints.


§9. PRIVACY POLICY AND PERSONAL DATA SECURITY

9.1

The Seller is the administrator of the personal data collected through the Online Store.

9.2

The Seller undertakes to protect personal data in accordance with applicable data protection laws.

By placing an order, the Buyer consents to the processing of personal data for order fulfillment purposes.

9.3 GDPR Information

In accordance with Article 13 of the General Data Protection Regulation (GDPR):

  1. The data controller is Daniel Cieślak, owner of FIT-SHOP Łódź.
  2. Personal data is processed for order fulfillment purposes pursuant to Article 6(1)(b) GDPR or based on the legitimate interest of the controller under Article 6(1)(f) GDPR.
  3. Data recipients may include courier companies, postal operators, authorized public authorities, and accounting/tax service providers.
  4. Personal data is processed for 6 years or as long as justified by the controller’s legitimate interest.
  5. The data subject has the right to:
  • access personal data,
  • rectify data,
  • erase data,
  • restrict processing,
  • object to processing,
  • withdraw consent,
  • transfer data.
  1. The data subject has the right to lodge a complaint with the supervisory authority.
  2. Providing personal data is voluntary but necessary for order fulfillment.

§10. FINAL PROVISIONS

10.1

The Seller reserves the right to amend these Terms and Conditions.

Registered Customers will be informed about changes via e-mail at least 14 days before the new Terms become effective.

10.2

The current version of the Terms and Conditions is always available on the Online Store website.

10.3

These Terms and Conditions apply from the moment an order is placed until it is completed.

10.4

Any disputes not covered by these Terms and Conditions shall be governed by applicable Polish law.

10.5

All product names and trademarks belong to their respective owners and are used for informational purposes only.

10.6

The Seller makes every effort to ensure that product descriptions and photographs accurately reflect the actual products.

10.7

Differences resulting from individual monitor settings cannot constitute grounds for complaints.

The Seller guarantees best efforts to obtain requested products as quickly as possible.
